The Aboriginal Heritage Amendment Act 2016

The Aboriginal Heritage Amendment Act 2016 (the Amendment Act) establishes new provisions and changes to the Aboriginal Heritage Act of 2006 - including the Preliminary Aboriginal Heritage Tests (PAHT).

The Aboriginal Heritage Regulations 2007 are currently being written with an intended publishing date in early August 2016.

Traditional owners will have greater oversight powers and a stronger role in managing and protecting Victoria’s Aboriginal cultural heritage.

Significantly, for the first time in Australia, the Victorian legislation will now provide for the explicit protection of intangible Aboriginal cultural heritage, such as stories, song and language.

Expected timeframe

Time frames differ according to the type of heritage project. As an example, a small urban development CHMP would take approximately 6-12 weeks to completion depending on the project and stakeholder timelines.

Do I need an Aboriginal Cultural Heritage Management Plan?

The Act provides guidance on what circumstances require a Cultural Heritage Management Plan (CHMP). From August 2016, a Preliminary Aboriginal Heritage Test (PAHT) <link to PAHT> will provide more certainty if you need to complete a CHMP.
