The Aboriginal Heritage Amendment Act 2016
The Aboriginal Heritage Amendment Act 2016 (the Amendment Act) establishes new provisions and changes to the Aboriginal Heritage Act of 2006 - including the Preliminary Aboriginal Heritage Tests (PAHT).
Traditional owners will have greater oversight powers and a stronger role in managing and protecting Victoria’s Aboriginal cultural heritage.
Significantly, for the first time in Australia, the Victorian legislation will now provide for the explicit protection of intangible Aboriginal cultural heritage, such as stories, song and language.

Do I need an Aboriginal Cultural Heritage Management Plan?
The Act provides guidance on what circumstances require a Cultural Heritage Management Plan (CHMP). A Preliminary Aboriginal Heritage Test (PAHT) will provide more certainty if you need to complete a CHMP.
